Sales and Use Tax Information: North Dakota Sales & Use Webpage: http://www.nd.gov/tax/salesanduse/ This site has the information SCDs will need to learn about the Sales and Use tax we need to collect. I have added links within the site that I thought might help you get started.
Fill in the application to register your SCD for the Sales & Use Tax Permit. (This only needs to be one time.) http://www.nd.gov/tax/salesanduse/forms/withholdsalesapplication-enabled.pdf You can fill in this form and print it out.
At the March 2008 Tree Promotion Workshop we were given instructions for filling out this Form. Here were the instructions: Fill in only questions: (Leave the rest of the questions blank.) Ø 1, 2, 4, 5, Ø 13 (fill in the date you fill out the form on), Ø 15 (Check Government), Ø 18 (The example provided us was Tree Planting __% Related Items __% - you have to determine your %. In Grand Forks we used 90% and 10%) Ø 19 (Your District Supervisors – You do not need to put their social security numbers or owned.) Ø 22 Check the box Ø 25 Check yes Ø 27 Is the business seasonal or part time (Check yes), Put NA in the remaining three spaces. Ø 28 SCD Manager or the employee that will be responsible for sales tax in your office. Skip the question about withholding tax matters Ø 29

Not sure what the sales tax rate is for the city you are selling in? Do you sell trees in more than one location? This link will have the information you are looking for. Ignore the first pages for lodging and restaurants, the local rates by city begin on page 4. http://www.nd.gov/tax/salesanduse/pubs/guide/gl-21847.pdf You will add this rate to the 5% state sales rate for example in Grand Forks the local rate of 1.75% is added to the 5% state sales rate for a total sales tax of 6.75%.

Form ST - Sales and Use Tax Return - (328kb fill-in pdf) - This is the form to report and transmit your sales and use collected each year. The deadline for filing this report is January 31st each year. Click the link below to get the link and bring up the form. You may file your sales and use tax returns over the Internet using the North Dakota Sales Tax WebFile.
